Lake Oswego Car Accident Attorney
Fighting for the Injured in Portland, Multnomah, Clackamas, and Washington Counties Since 1984
Auto accidents occur every day in the Greater Portland Area, as well as across the state of Oregon. These accidents can be devastating for those involved, resulting in injuries ranging from whiplash to traumatic brain injuries, spinal cord damage, fractures, and neck and back injuries. When such injuries occur due to the negligence, recklessness, or wrongdoing of others, victims may seek recovery for the losses and damages they have sustained. Personal injury law protects you, allowing you to file a claim against the at-fault party/parties to recover the compensation you need to restore your health and life as much as possible.
The Law Offices of Scott M. Supperstein, P.C. has been helping injured clients and their family members seek maximum compensation for their damages since 2001. Our Lake Oswego car accident lawyer, Scott Supperstein, knows how to combat insurance company tactics meant to pay you as little as possible. He also knows how to negotiate with insurance adjusters or litigate on your behalf if necessary. Throughout all phases of your case, we treat you like family with personalized attention. Our goal is to help you through this crisis as smoothly and painlessly as possible so that you can safely move forward.
Oregon's Statute of Limitations for Car Accidents
According to Oregon's Revised Statutes Section 12.110, victims of car accidents are able to file a lawsuit for up to 2 years after the date of their accident. However, if somebody was killed in the accident and someone desires to file a wrongful death claim, the claimants will have up to 3 years from the date of the underlying injury, rather than the usual 2 (Oregon Revised Statutes section 12.080).
If the injured party fails to submit their suit within the allotted timeframe they run the risk of their case being dismissed by the court.
Examples of Negligence in Car Accident Cases
Rear-end collisions, T-bone crashes, rollovers, and fender benders can all be caused by a variety of negligent driving behaviors and other factors.
Your injuries may have been the result of negligence such as:
- Distracted driving (texting, talking on a cell phone, eating, drinking, talking to passengers, etc.)
- Inattention or fatigued driving
- Driving under the influence of alcohol and/or drugs
- Failing to stop at signals and stop signs
- Failing to check blind spots before lane changes
- Poor road maintenance
- Defective road design
What Kind of Compensation Might I Be Entitled To?
In all of the above examples, the at-fault party or parties can be held responsible for:
- Your pain and suffering
- Medical expenses
- Loss of wages or income
- Physical therapy
- Any other injury-related expenses
Through intensive investigation, as well as through the gathering of medical reports, physical evidence, police reports, witness statements, and more, we can build your case to pursue a fair and just settlement.
